Whaley Bridge : No murder charge for homeowner after CPS review

No charges to be brought against Whaley Bridge homeowner after fatal shooting during alleged burglary

A man arrested on suspicion of murder following the fatal shooting of a teenager during an alleged burglary in Whaley Bridge has been released without further action.

Derbyshire Constabulary confirmed that specialist lawyers at the Crown Prosecution Service have decided not to bring a murder charge against the homeowner, a man in his 50s.

Police were called to a property in Whaley Bridge during the early hours of 1 May 2024 following reports of a burglary.

At the scene officers found 19-year-old Marcus Smith, from Chapel-en-le-Frith, who had suffered a fatal gunshot wound. He was pronounced dead at the scene.

The homeowner was arrested on suspicion of murder and has remained on police bail while detectives carried out an extensive investigation.

Following the completion of that investigation, Derbyshire Constabulary submitted a file of evidence to the Crown Prosecution Service for consideration.

In an update issued today, the force said the CPS had decided that no murder charge would be brought and the man has now been released from police bail with no further action.
